6.1   Rules of using the Pag Service

Article 1 DEFINITIONS

The terms used in the Rules mean:

PAG: Professional Automotive Group spółka z ograniczoną odpowiedzialnością, ul. Górecka 23, 60-201 Poznań, NIP [Taxpayer ID Number:] 7792490347, REGON [Business ID Number:] 380279708, entered in the Register of Entrepreneurs kept by the District Court Poznań Nowe Miasto i Wilda in Poznań, 8th Commercial Division KRS, number KRS 0000732926,

SERVIS: the commercial open platform run by PAG in the Polish language,

USER: an entity which has been given access to PAG service according to the rules described in the Rules,

ACCOUNT: an account run for the User by PAG under a unique name (login) consisting of a number of resources, where the User’s data and the information on their actions within the PAG service are collected,

REGISTRATION: the procedure of opening an account,

RULES: the Rules of the PAG service

Article 2 CONDITIONS OF USING THE SERVICE

2.1. The Users can be natural persons who are 18 years old and older, with full legal capacity, legal persons and organization entities without legal personality, but who are able to acquire rights and incur liabilities in their own name. The Users can be persons aged 13 and older who have not reached the age of 18, within the scope in which they can acquire rights and incur liabilities in accordance with the regulations widely applicable by law.

2.2. The Registration of a user can be done by a person who is authorised to perform in their name all activities connected with the Registration and to exercise all rights and duties of the User. In order to register, the person should fill in the registration form by giving the name, legal form, address and the seat/place of residence, as well as their first and last name, address, E-mail address, phone number, full name of the company/entity registered and the address of its seat along with the name of the country and region (province); the next step is to send to PAG a copy of the documents confirming the above-given data within a month from the day of the Registration.

2.3. Once the data have been filled in and their authenticity confirmed in the registration form, a message shall be sent on the E-mail address given therein as to how to confirm the Registration and which shall contain the information required by law. The moment of confirmation of the Registration results in conclusion of an agreement between the registered entity and PAG the subject of which are the services rendered by PAG on the conditions stipulated in the Rules. 

2.4. PAG may condition the Registration or using their service by the User on the authentication of their data given above. In such cases, the User shall be obliged to sent copies of the documents confirming the data they have submitted.

2.5. After the successful Registration, PAG shall create the User’s Account with a name (login) assigned to it. The User who has successfully completed the Registration, receives access to the Account once they have entered their login and password (logging) in the PAG service. The E-mail address entered by the User may be used as their login. The User who has registered via the Facebook service or has linked their account in the PAG service with an account in Facebook can also log in via application Facebook Connect.

2.6. Logging to the PAG service via WebAPI and via application Facebook Connect shall have the same results as logging directly in the website of the PAG service.

2.7. The data given by the User during the Registration shall be contained in the Account. Should any data of the User change at a later time, they should up-date them immediately by using the appropriate form available on an the website of PAG. Th User must neither remove the data stipulated in Art. 2(2) while using the services of PAG nor can they submit incomplete or false ones.   Once the Registration has taken place, there is no possibility to change the name of the Account (login) accepted during the registration. For each Account, there has to be assigned a different E-mail address.

2.8. In order to have access to the services rendered by PAG, the User has to conduct the Registration and activate the Account by filling in a special form available on the respective website of PAG, then by receiving a letter with the activation code sent by PAG to their correspondence address and entering the code on the website given by PAG.

2.9. The User must not have more than one Account.

2.10. The User must not use the Accounts of other Users. Nor are they allowed to give access to their Account to third parties. The User who has given the access to their Account bears full responsibility for all actions performed by the entity to which the Account has been made available.  The User should keep secret the password to the Account. 

2.11. The Accounts are non-transferable.

2.12. Should PAG have determined that the Account has not  been secure, the company  reserves the right to temporarily block the Account or the access to selected services. PAG may condition the continuation of using the Account on changing the password to access it  Once the password has been changed, the User shall immediately be able to access their Account.

2.13. Using the Account to the detriment of other Users of the PAG service is forbidden.

Article 3 PRIVACY AND CONFIDENTIALITY

3.1. The personal data made available by the Users are collected by PAG and processed in accordance with the applicable regulations of law and with the policy of privacy protection included in Appendix No 1 to the Rules. 

3.2. The Users get access to the personal data of other Users only in the cases stipulated in the Rules and other well justified ones, with the prior consent of the person whom they concern. 

3.3. The User shall not reveal to any third parties the information on other Users they have received from PAG in connection with using the PAG service, unless the User has obtained prior consent of the User whom the data refers to.

 

Article 4 CHANGES OF THE RULES

4.1. PAG may change the Rules. An amendment becomes effective on the day indicated by PAG which cannot be earlier than 7 days from the moment of making the amended Rules available in the PAG service.

4.2. During the first log-in after the amendments have been introduced, the User shall be informed of them and the possibility to accept them. Further using of the PAG service shall be considered as the acceptance of the changes. The refusal to accept them means terminating the Agreement with PAG with the effect stipulated in Art. 5(1).

Article 5 TERMINATION

5.1. Rendering the services within the PAG service is indefinite subject to the next sentence and the provisions included in Art. 5(2) underneath. The User can any time terminate the Agreement with PAG by filling in the form available on the respective website, which includes the termination statement, and then by confirming all the entered data: the name (login) and password.   With consideration of the condition stipulated in 5(4), the Agreement shall be terminated with immediate effect at the moment of confirming the data.

5.2. Due to important reasons, the Agreement may be terminated by PAG with immediate effect.

5.3. If the agreement has been terminated on the basis of a decision of PAG, the User cannot re-register in the PAG service prior to obtaining their consent. 

Article 6 CONTACT AND COMPLAINT PROCEDURE

6.1. The User can contact PAG in the following ways:

A. in written on: 60-201 Poznań, ul. Górecka 23,

B. by means of the “Contact” link available on home page of PAG, after selecting the topic of the correspondence in the contact form. 

6.2. The User can make a complaint if the services included herein are not being performed by PAG or are performed not in accordance with the provisions of the Rules.

6.3. A complaint can be made electronically in a contact form or in written. It should include at least the name under which the User appears in the PAG service (login) and the description of the reported reservations.

6.4. Should the data contained in the complaint need completing, prior to its consideration PAG refers to the claimant with the request to complete them within a given period of time.

6.5. PAG shall process a complaint within 14 days from the date of its reception provided it is complete and sent properly, with the reservation that they may refuse to consider processing complaints lodged after 90 days from the moment of revealing their reasons.

6.6. The response to the complaint shall be sent exclusively to the E-mail address assigned to the Account of the particular User. In particularly well justified cases, PAG may send their response to another E-mail address submitted by the claimant which is not assigned to the Account of the User.

Article 7 APPLICABLE LAW AND DISPUTES

The governing law for the agreement between the User and PAG, the subject of which are the services rendered by PAG within their service on the conditions stipulated in the Rules, is the Polish law. Any disputes arising from the services rendered by PAG and not settled amicably shall be settled by the District Court Poznań-Stare Miasto in Poznań or the Regional Court in Poznań, depending on which of these two shall be the court with material jurisdiction. A User who is a consumer may use an out-of-court dispute resolution and seek their claim before the Permanent Consumer Arbitration Court at the Voivodeship Inspectorate of the Trade Inspection in Poznań. The information on the way of access to the above-described course of action and procedures of settling disputes can be found on www.uokik.gov.pl in tab “Settlement of consumer disputes”.

Article 8 APPENDICES

The Rules include the following appendices which constitute their integral part:

Appendix no 1: Privacy protection policy; 

Appendix no 2: Cookie policy;

Article 9 VALIDITY

Should any of the provisions of the Rules be declared invalid by a final court decision, all other provisions shall remain effective.
